Gambling in any form is not legal in New York State and anyone marketing an illegal product to a New Yorker is in violation of the law and can be prosecuted, even though actual charges stemming from this are very rare.

Actual prosecutions of advertisers for promoting gambling are rare, but the advertising agencies are still insisting they are not breaking the law.
