Despite the fact that smoking inside of casinos is illegal in Colorado several casinos still continue to allow smoking on the casino floor

The Midnight Rose Hotel and Casino in Cripple Creek is being charged with breaking Colorado's Clean Indoor Air Law.

The trial will begin at 3PM on Thursday September 11th the casino is being charged with not complying to a ban on smoking that went into effect on January 1st 2008. at first the casino did comply with the ban on smoking, but after several months they began to allow indoor smoking using the claim that they were a cigar bar and exempt from the law.

According to Stephanie Steinberg the chairwoman of Smoke Free gaming of Colorado, smoking is taking place in the casino and since a casino is licensed primarily as a casino and not as a bar or Cigar-Tobacco bar, it is not eligible to be exempt from the smoking law.

Smoke Free gaming of Colorado is the organization that was most responsible for getting casinos added to a list of business that would be banned from having smoking indoors.

Four casinos in Cripple Creek were giving citations for breaking the Clean Indoor Air Law. Since being given the citations two casinos have started enforcing the law.

Colorado currently has 42 casinos within the cities of Black hawk, Central City and Cripple Creek. Two casinos in Cripple Creek and one in Black Hawk continue to allow players to smoke in the casinos.
